Plant Variety Certificate

Plant variety protection rights require that the variety to protect be new, distinct, uniform, and stable. 

It is organised within the framework of the UPOV Convention revised in 1972, 1978 and 1991. The French Plant Variety Certificate (PVC) confers protection in France and complies with the UPOV convention of 1978. 

The Community Plant Variety Rights system (CPVR), established by Council Regulation (EC) 2100/94, confers a single protection for the entire European Union and is in accordance with the UPOV Convention of 1991. 

The PVC AND CPVR protections may not be combined. Protection is accessible to any variety belonging to a species of the plant kingdom, but the protected material is different according to whether its protection is a PVC or a CPVR, as well as the limits of the protection. 

The term of protection is 25 years from the date of the grant of protection (30 years for certain exceptions).
