Supplementary Protection Certificate

This title, introduced by the French law of 25 June 1990, extended the life of certain patents pertaining to medications.

This is now governed by the Parliament and Council regulation of 6 Mayfor medications, which resulted in a Marketing Authorisation Application (MAA) and protected by an active patent. 

This title may be obtained under the same conditions in all the Member States of the European Union.

The duration of the certificate may not exceed 5 and a half years from the date of the expiration of the patent. In matters of pediatrics, an extension procedure of six months may be invoked one time only.
