The information on this site may contain technical inaccuracies or typographical errors. This information may be modified or updated without notice. The CNCPI may also, at any moment and without notice, improve and/or modify the products and/or services described on the site.
All information published on the cncpi.fr site may contain direct or indirect references to products and services which are not advertised or available in your country.
Personal data
The CNCPI, which is responsible for data processing, collects personal data about its members and users in the following cases:
- for signing up members to the CNCPI,
- for all requests for information or documentation,
- for all registrations to events organised by the CNCPI (discussions, conferences, salons, workshops, future training sessions…),
- for all subscriptions to CNCPI newsletters.
This information may include contact data such as your name, postal address, email address (personal or professional), telephone number, job, or French patent and trademark attorney number.
The legal basis and purposes of such processing are:
- the respect of legal and regulatory obligations linked to the functions of French patent and trademark attorneys s, in particular to articles R.421-1 and in accordance with the Intellectual Property code
- the legitimate interest of the CNCPI to communicate, manage, and organise meetings, activities, or events for its members and users, and more generally to promote and lead campaigns for the awareness and promotion of intellectual property among the general public.
The CNCPI takes precautionary technical and organisational data usage measures in order to protect personal data, to preserve its integrity, and especially so that it will not be communicated with any unauthorised third parties.
This personal data will not be shared with third parties except, if applicable, when the user opts to use the Directory functionality to directly contact the CPI Firm of his choice by email via the messaging system, to the web site operator, to another professional association as part of the organisation of meetings or events held with it, or to the service provider in charge of the organisation of these events, or to the bank in case of enrolment and online payment by the concerned member.
In the context of meetings and events with another professional association, the CNCPI may transfer the abovementioned data to a third country or an international organisation as defined in the Regulation.
The CNCPI ensures regulatory compliance for this transfer as the data subject has given his explicit consent for the proposed transfer.
The data relative to members of the CNCPI is stored during the entire period during which the French patent and trademark attorneyis a member of the CNCPI, prolonged by the duration of applicable limitation period.
The data relative to users is stored for 3 years after the last request for information or registration to CNCPI events.
The user is informed that that he has the rights of opposition, access, rectification, erasure, opposition, data portability, and limitation of the nominative and personal data regarding him/herself, by writing to the following address: CNCPI - 13 rue du Quatre Septembre, 75002 PARIS or via email to: rgpd@cncpi.fr.
In accordance with applicable legal and regulatory provisions, concerned persons may submit a claim to the French supervisory authority, the National Commission for Data Protection and Liberties (CNIL), at 3 Place de Fontenoy - TSA 80715 - 75334 PARIS CEDEX 07, or www.cnil.fr.
Cookies
The user is informed that a cookie may be automatically installed on his browser during his visit to the cncpi.fr site. This cookie is only used to store information relative to the user’s navigation on the site in order to improve the quality of the site.
Directory
The directory provided by the cncpi.fr site is comprised of the list of physical persons on the list of French patent and trademark attorneys as well as the contact details of legal entities enacted by decree n° 92-360 of 1 April 1992, decree n° 2007-731 of 7 May 2007, and more generally by Title II of the de la intellectual property code. In accordance with compliance to the above rules, a person on the list may, at any time, request the CNCPI to update his information.
The CNCPI provides no commitment as to the exactitude of the information contained in its directory and declines all responsibility in case of omission or error.
The CNCPI web site offers, in its “Directory” section, a functionality enabling the user to directly contact the Intellectual Property firm of his choice by email via a messaging system by clicking on the icon representing an envelope: “send an email”. The user then has the possibility of sending his contact details (name/address, email, and company or organisation, if desired) as well as a written message to the selected firm.
The Intellectual Property firms which may be contacted via this functionality have authorised the CNCPI to transfer the data cited above and are committed to handling this data respecting the following conditions et processing purposes:
- The purposes of processing are: to enable the CPI Firm to contact the user to respond to a request for information in view of an eventual offer of service
- Personal data processed are: contact details of the user who contacted the CPI Firm via the CNCPI internet site directory, including: name, email address, and, eventually, company or organisation
- The categories of concerned persons are: users of the CNCPI (www.cncpi.fr) internet site who have contacted a CPI Firm selected from the directory which is at their disposal.
The Intellectual Property Firm will delete personal data received within three years following the final request by the user in the absence of any commercial relation.
The Intellectual Property Firm will not sell nor transfer personal user data received via the functionality of the CNCPI site.
The Intellectual Property Firm will respond to user requests to exercise user by this transfer of data: right of access, rectification, erasure and blocking, right of restriction of processing, right to data portability, right not to be subject to a decision based solely on automated processing (including profiling).
The Intellectual Property Firm will notify the CNCPI of any personal data breach within 48 hours after becoming aware of the violation, by email to the address rgpd@cncpi.fr. This notification is to be accompanied by all useful documentation in order to enable the CNCPI, if necessary, to notify the competent authorities about the violation.
Intellectual and Industrial Property Rights
All elements of the creations contained in this web site (texts, photographs, illustrations, logos, icons, downloadable files, written and/or graphic trademarks, etc.) constitute works protected in France by the Intellectual Property Code, and abroad by the international conventions in force pertaining to copyright.
Putting this website on line is not a license to use the intellectual property mentioned. No such use may be made without the prior written express permission of the owner.
Modifications to the web site
The CNCPI reserves the right to modify or correct the content of their site, and to temporarily interrupt or permanently discontinue all or part of their site and to their terms and conditions at any time, without prior notice to the user.
Applicable law
Any dispute arising under or in any way connected with these Terms and Conditions shall be referred to the courts of Paris, and will be governed and analysed according to French law independently of the rules concerning conflicting legislation. By using the cncpi.fr sites, you expressly agree to the application of these clauses relating to jurisdiction. If any provision in these Conditions is or becomes invalid for any reason whatsoever, this shall not prejudice the applicability of all the other provisions of these Conditions.
